(b)                                 Effective May 21, 2013, Eran Cohen resigned from his position as Executive Vice President, Chief Marketing Officer of New York & Company, Inc. (the “Company”) to pursue another opportunity. Mr. Cohen will remain with the Company for a transitional period. The Company noted that its marketing strategy remains in place under the direction of its strong and very talented marketing team and it has begun a search for a new Chief Marketing Officer.
