            On June 28, 2005,  Empire Resorts,  Inc.  issued a press release,  a
copy  of  which  is  attached  hereto  as  Exhibit  99.1,  affirming  that it is
continuing  its  efforts to  develop a casino for the Cayuga  Nation of New York
following  a decision  by the  United  States  Court of  Appeals  for the Second
Circuit.
