Insurance Law Podcast Discusses Recovery of Attorneys’ Fees in Maritime Matters

A.M. Best has released the latest installment of the Insurance Law Podcast, a series that examines timely insurance issues from an attorney’s point of view.

This episode features attorneys Edward Radzik and Lori Quinn of Marshall Dennehey Warner Coleman & Goggin, a law firm with offices in multiple states, including Pennsylvania, New York and New Jersey. Mr. Radzik and Ms. Quinn are shareholders in the maritime litigation practice group, located in the firm’s New York office. Mr. Radzik, a former marine engineer who serves as Chair of the Carriage Goods Committee of the Maritime Law Association of the United States, focuses on the prosecution of claims for cargo loss and damage. Ms. Quinn, an active member of the Maritime Law Association, the National Association of Subrogation Professionals and the Claims and Litigation Management Alliance, manages the firm’s maritime subrogation practice and focuses on cases involving aviation and maritime related personal injury, cargo recovery and property damage.

Mr. Radzik begins by defining the “American rule” as it relates to allocation of attorneys’ fees. He then explains how this rule applies to maritime cases and points out exceptions to its application. Ms. Quinn discusses when attorneys’ fees may be awarded in maritime litigation and arbitration.
