The law that caused the Justice Department to call NYC 'soft on crime' is set to take place in October. The law will allow certain classes of people to hide 10 years of priors from the public record.

A new law deems age of criminal responsibility in the state of New York will be raised from 16 to 18.

The law has been modified to allow convicted criminals the opportunity to hide their criminal history from public records. Past criminals with 10 or more crime-free years can now hide up to two convictions prior to that period. New York state attorney Rick Collins who helped the New York State Bar Association reach this decision, stated that this will open doors for people with a criminal history to find jobs, be eligible for loans and not halt their efforts in making life changes.

In general, New York state’s total violent and property crimes have been slowly declining since 2005.

Of course, law enforcement can still view such records, it’s only private investigators and the public who are blocked from accessing them.

The law is set to be applied sometime in October, at which point tens of thousands of people could put in a request to seal their criminal history from 10 years prior.

How the law will be implemented on the population:

• People with past convictions will need to submit an application to the authorities with local jurisdictions (no information on the application has been disclosed as of yet).
• The office of the district attorney and victim of the crime (if any) will have a say in how successful the previously convicted person’s application will be.
• A judge will be the final arbiter of whether an application for sealing will be put into effect case by case.
• Eligibility for such applications doesn’t include past violent criminals, sex offenders, terrorists, or drug dealers who dealt in large quantities of illegal substances.
• An applicant will have only up to two misdemeanor records and one felony record that they’re able to seal.
• The waiting period of 10 years starts on the day that the criminal has been released from prison.

The New York state senate assembly that took place on January 23rd, 2017 voiced the financing of this law as part of its budget bill.
