ITEM 8.01. Other Events.

On October 8, 2008, we received $104,600,472 from EchoStar, which includes approximately $74 million in initial damages awarded by the United States District Court for EchoStar’s willful patent infringement and supplemental damages covering the period through September 8, 2006 as well as related interest through October 8, 2008.
