Mixing standards with patents is a paradox in itself. While patents aim to exclude, standards aim at the exact opposite. The FRAND (fair, reasonable and non-discriminatory) Commitment seeks to patch the two together.

But how can this work in practice?

This conference brings together the key players, movers and shakers in the high tech industry to debate the Future of FRAND and standard essential patents. The topic is far from hypothetical. As 5G increasingly gains momentum, governments, courts and practitioners around the world seek to come to grips with the management of patents that read on standards.  The US Government’s recent Department of Justice’s consultation, the UK Intellectual Property Office’s public enquiry on FRAND as well as a similar consultation undertaken by the European Commission, suggest that the last word on this topic has not yet been said.

Equally of importance are the Unified Patent Court, which will offer the European Union an entirely new framework for pan European patent enforcement and sets a global precedence for cross border patent enforcement.  Its impact on patent litigation strategy is yet to be seen and will equally be addressed at the conference.

The third key theme of the conference will be the role of patent aggregators, patent pools and patent platforms. What would be needed to establish trust in these entities?

Sates Professor Roya Ghafele, Founder of OxViews: ‘The incredible list of contributors to the conference includes Fortune 100 corporations, globally renown law firms, scholars and judges. Without a doubt, the event offers unique insights on the future of patent and competition law at the global level. With Europe being at the brink of launching a Pan European Patent Court, the Brits considering their country’s position on standard essential patents and the European Union seeking equally to come to grips with the role of competition law in addressing Standard Essential Patents, this event is well placed to offer a forum for debate on current trends and future prospects for the high tech space. ’

The conference is sponsored by Allen & Overy, Gruenecker Patent Attorneys and Attorneys at Law, Eisenfuehr Speiser, Meissner Bolte, Vossius, Bristows, Kirkland & Ellis, Taylor Wessing, Acces Advance, CMS, Finnegan, Henderson, Farabow, Garrett & Dunner and OxFirst. Further support is offered by institutions such as FSA, Trevisan & Cuonzo, Sheppard Mullin, Frand Avenue, Continental, ZTE, Ernst & Young, Bird & Bird.
