"Insurance companies frequently contact an injured person before they hire an attorney, act friendly, and try to get you to talk about the accident and your injuries," Nugent said. "They lock you into a recorded statement so they know they know as much as they can about the case, and then make you an offer that is many times much, much less than what your claim is actually worth." Beyond recorded statements, Nugent warns that insurers now routinely scan claimants' social media profiles for photos, posts, or check-ins that can be used to challenge the severity of an injury, call a victim's credibility into question, or learn about your life and interests. He advises all injury victims to be especially careful about posting on social media after an accident and to consult an attorney before making any contact with the opposing insurance carrier.
Nugent also weighed in on a parallel shift taking place in New Jersey criminal law. While prosecutors and legislators have historically favored tough sentencing, Nugent sees a growing recognition that rehabilitation and diversion programs often produce better outcomes than incarceration. "There is a movement with a lot of states that rehabilitation and programs like veterans assistance, conditional dismissals, pretrial intervention and recovery courts for addiction are far more effective in helping people and reducing crime than putting people in jail," he said. "Getting people help works better than mass incarceration." For criminal defense clients, Nugent's longstanding guidance remains firm: exercise your Fifth Amendment right to remain silent, and do not speak to law enforcement without an attorney present. "Too often people think they can talk themselves out of a problem," he said, "and they talk themselves into a much deeper problem."
